TERMS AND CONDITIONS

1. AGREEMENT TO TERMS

We are MFTK Martial Arts, doing business as MFTK Martial Arts Academy (“Company,” “we,” “us,” “our”). We operate the website mftk.ca (the “Site”) to provide information about our Taekwondo classes and services. By accessing the Site, you agree to these terms. Users must be at least 18 years old; minors must have a parent or guardian review these terms.

2. INTELLECTUAL PROPERTY

We own all content on this Site, including instructor bios, photography, blog posts, and logos. You are granted a limited license to view the Site for personal, non-commercial use. You may not scrape, copy, or “borrow” our content or instructor descriptions for competing businesses without written permission.

3. USER REGISTRATION

If you create an account to manage your memberships or classes, you are responsible for maintaining your password confidentiality. We reserve the right to terminate accounts that provide false information or violate our community standards.

4. PAYMENTS & REFUNDS

All fees for memberships or classes are processed in CAD. Since we do not sell physical merchandise via this Site, all sales (such as registration fees or tuition) are governed by our in-studio refund policy. Generally, all online payments are final unless otherwise stated in your specific membership agreement.

5. PROHIBITED CONDUCT

As a user of this Site, you agree not to:

  • Scrape Data: Use automated scripts or bots to collect information from our Site.
  • Security Breaches: Attempt to bypass security features or interfere with the Site’s hosting (Google Maps).
  • Harassment: Use our contact forms to harass, abuse, or discriminate against our instructors, staff, or other members.
  • Competing Solicitations: Use the Site to recruit our members or instructors for other businesses.

6. THIRD-PARTY SERVICES (GOOGLE MAPS)

Our Site uses Google Maps API to help you find our Toronto/Markham location. By using the map, you agree to Google’s Terms of Service. We do not independently collect or store your location data through this API.

7. PRIVACY

Your privacy matters. Please refer to our mftk.ca/privacy-policy for details on how we handle your data in accordance with Canadian privacy laws (PIPEDA).

8. DISCLAIMER & LIMITATION OF LIABILITY

The Site is provided “as-is.” We are not liable for any technical errors or service interruptions.

  • Physical Activity: While this Site provides information about Taekwondo, participation in physical classes is subject to a separate Physical Waiver & Release signed in person at our studio.
  • Liability Cap: To the extent permitted by Ontario law, our total liability for any claim related to Site use is limited to the amount you paid us in the last six months or $500 CAD, whichever is less.

9. SMS COMMUNICATIONS

By opting into our SMS service, you agree to the following:

  • MFTK Martial Arts provides mobile alerts, including class reminders, appointment updates, responses to inquiries, and special promotional offers. Ex. “Hi Dennis! This is Chris from MFTK Martial Arts. Our appointment for February 11 08:00 AM is confirmed. Please reach out to 416-440-1881 in case you need to reschedule. Reply STOP to unsubscribe.”
  • Cancellation: You can cancel the SMS service at any time. Just text “STOP” to 416-440-1881. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
  • Support: If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at admin@mftk.ca.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Rates and Frequency: As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive at the maximum 60 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

10. GOVERNING LAW & DISPUTES

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada.

  • Negotiation: We agree to attempt to resolve any disputes informally for 30 days.
  • Arbitration: Any remaining disputes shall be settled by binding arbitration in Toronto, Ontario.
